PROCEDURES AND PRINCIPLES REGARDING VISITING LECTURER AND RESEARCHER


SECTION ONE

PURPOSE, SCOPE, BASIS, AND DEFINITIONS

 

Purpose and Scope

ARTICLE 1 - (1) The purpose of these procedures and principles is to define the admission procedures of visiting lecturers and visiting researchers to Izmir University of Economics, their responsibilities, and opportunities they can benefit; and to determine the authorities and responsibilities of the relevant units of Izmir University of Economics within the scope of the defined procedures.

 

(2) Foreign lecturers employed in accordance with the Article 34 of the Higher Education Law No. 2547 are not within the scope of these Procedures and Principles.

 

Basis

ARTICLE 2- (1) These principles have been prepared based on Article 14 of the Higher Education Law No. 2547 and the "Procedures and Principles Regarding the Employment of International Academic Staff" adopted by the Executive Board of the Council of Higher Education dated 15.01.2020 and the Regulation on the Implementation of the Law on Work Permits for Foreigners.

 

Definitions

ARTICLE 3 - (1) The references in these procedures and principles are as follows:

 

a) Ministry: Turkish Ministry of Family, Labor and Social Services

 

b) Visiting Researcher: Visiting academics working as teaching staff in any institution or organization, higher education institution in the country or abroad, or researchers within the scope of one of the below categories to participate in research activities:

 

  • Senior Researcher (PhD degree and more than 5 years of research experience),
  • Postdoctoral Researcher (not exceeding 5 years from the date of obtaining the PhD degree),
  • Researcher (for people without a PhD degree but with professional or research experience)

 

 

c) Visiting Lecturer: Visiting academics who work in an institution or organization, higher education institution in the country or abroad and come to Izmir University of Economics to give lectures or to conduct research in addition to giving lectures,

 

ç) Lecturers: Faculty members, lecturers and research assistants working in higher education institutions,
 

d) Faculty Members: Professors, associate professors and assistant professors working in higher education institutions,
 

e) Rectorate: The Rectorate of Izmir University of Economics,

 

f) Senate: The Senate of Izmir University of Economics,

 

g) Turkish National: A person who has ties of citizenship with the Republic of Turkey.

 

ğ) University Administrative Board: University Administrative Board of Izmir University of Economics,

 

h) University: Izmir University of Economics,

 

ı) Foreign National: A person who does not have ties of citizenship with the Republic of Turkey.

 

 

SECTION TWO

GENERAL PROVISIONS

 

Application and Admission for Visiting Lecturers

ARTICLE 4- (1) Visiting lecturers can be accepted to give lectures or to conduct research while giving lectures at the University upon their own application or the proposal of the faculty members of the University or related units. Applications are made considering that official approval processes may take at least 2 months.

 

(2) Resumes of visiting lecturers, an official letter from the institution they are affiliated with, an information form explaining how long and for what purpose they will be invited, are submitted to the faculty/school/vocational school/graduate school/center administrative board.

 

(3) Invitation and acceptance of Turkish and foreign national lecturers for up to two months can be realized with the approval of the Rector upon the reasoned proposal of the head of the relevant department/program and the recommendation of the faculty/school/vocational school/graduate school/center administrative board.

 

(4) Invitation and acceptance of Turkish and foreign national lecturers between two and six months can be realized with the approval of the University Administrative Board upon the reasoned proposal of the head of the relevant department/program and the recommendation of the faculty/school/vocational school/graduate school/center administrative board.

 

(5) Applications and admissions of foreign national lecturers who want to give lectures or conduct research while giving lectures at the University for more than six months are carried out in accordance with the “Procedures and Principles Regarding the Employment of International Academic Staff" adopted by the Executive Board of the Council of Higher Education dated 15.01.2020.   

 

(6) In the applications and admissions of Turkish national visiting lecturers who want to give lectures or conduct research while giving lectures at the University, the procedures and principles regarding the teaching staff with hourly wage are applied.

 

Financial Obligations Regarding Visiting Lecturers

ARTICLE 5 – (1) Izmir University of Economics does not pay any fee to foreign national visiting lecturers who will give lectures or conduct research while giving lectures at the university for less than two months. However, in case of working within the scope of a project, foreign national visiting lecturers can be paid by the project partner or the funding institution within the scope of the project budget. The faculty/school/vocational school/graduate school/center administrative board, indicated in Article 4, decides about by which project budget and institution the payment will be made from.

 

(2) Depending on the permissions to be obtained from the Council of Higher Education, the necessary procedures regarding payment and insurance are carried out by the Human Resources Directorate of the University with general procedures and principles, for foreign national visiting lecturers, who will give lectures or conduct research while as giving lectures at the university for two to six months.

 

(3) The procedures and principles regarding the teaching staff with hourly wage are applied by Izmir University of Economics, with the approval of the Rectorate, for Turkish national visiting lecturers who want to give lectures or conduct research while giving lectures at the University for less than six months.

 

(4) The “Procedures and Principles Regarding the Employment of International Academic Staff" adopted by the Executive Board of the Council of Higher Education dated 15.01.2020 are applied for foreign national visiting lecturers who will give lectures or conduct research while giving lectures at the University.   

 

Application and Admission for Visiting Researchers

ARTICLE 6- (1) Visiting researchers can be accepted to conduct research at the University upon their own application or the proposal of the faculty members of the University or related units. Applications are made considering that official approval processes may take at least 2 months.

 

(2) Resumes of visiting researchers, an official letter from the institution they are affiliated with, an information form explaining how long and for what purpose they will be invited, are submitted to the faculty/school/vocational school/graduate school/center administrative board.

 

(3) Invitation and acceptance of visiting researchers for up to one month can be realized with the approval of the Rector upon the reasoned proposal of the head of the relevant department/program and the recommendation of the faculty/school/vocational school/graduate school/center administrative board.

 

(4) Invitation and acceptance of visiting researchers for more than one month can be realized with the approval of the University Administrative Board upon the reasoned proposal of the head of the relevant department/program and the recommendation of the faculty/school/vocational school/graduate school/center administrative board.

 

(5) Applications and admissions of foreign national lecturers who want to conduct research at the University for more than six months are carried out in accordance with the relevant provisions of the “Regulation on the Implementation of the Law on Work Permits for Foreigners”.

 

(6) In the applications and admissions of Turkish national visiting researchers who want to conduct research at the University, the decisions to be taken by the Rectorate are applied.

 

(7) Turkish national visiting researchers who want to conduct research at Izmir University of Economics within the scope of programs such as "Domestic Post-Doctoral Research Scholarship" or "Scientist Support Program with Guest or Academic Leave (Sabbatical)" carried out by TUBITAK are not within the scope of these procedures and principles.

 

Financial Obligations Regarding Visiting Researchers  

ARTICLE 7 – (1) Izmir University of Economics does not pay any fee to foreign national visiting researchers who will conduct research at the University for less than one month. However, in case of working within the scope of a project, foreign national visiting researchers can be paid by the project partner or the funding institution within the scope of the project budget. The faculty/school/vocational school/graduate school/center administrative board, indicated in Article 4, decides about by which project budget and institution the payment will be made from.

 

(2) Foreign national visiting researchers, who will conduct research at the University for more than one month within the scope of sabbatical leave and/or using their own financial resources, must get the necessary permissions such as residency permit from the Ministry according to the relevant provisions of the “Regulation on the Implementation of the Law on Work Permits for Foreigners”.

 

(3) In the event that a post-payment requirement arises for foreign national visiting lecturers within the scope of paragraph 2 of this Article, necessary procedures regarding payment and insurance are carried out by the Human Resources Directorate of the University with general procedures and principles.

 

(4) In cases where a fee is required to be paid by Izmir University of Economics, the necessary procedures regarding payment and insurance are carried out by the Human Resources Directorate of the University with general procedures and principles, for Turkish national visiting researchers, who will conduct research at the University for less than six months.

 

Implementation Conditions

ARTICLE 8- (1) Visiting lecturers and visiting researchers are given “Izmir University of Economics Guest ID Card”. Visiting lecturers and visiting researchers can benefit from the library, information services, cafeteria, student dormitory, depending on availability, and social facilities.

 

(2) It is decided by the Rector upon the recommendation of the relevant faculty/school/vocational school/graduate school/center administrative board, whether the facilities such as offices, laboratories etc. will be provided for visiting lecturers and visiting researchers or not and whether other expenses such as accommodation, transportation, and meals will be covered.

 

(3) Visiting lecturers and visiting researchers are obliged to comply with the rules and legal regulations of the University.

 

(4) The Rectorate may determine the upper limit for the number of visiting lecturers and visiting researchers to be admitted to Izmir University of Economics each year, for the whole university or for faculties/schools/vocational schools/graduate schools/centers.

 

(5) In cases where it is foreseen that faculty members or lecturers among those accepted or invited as guest researchers will give lectures later, a decision is taken again in accordance with the provisions of these procedures and principles.

 

Provisions Applicable to Foreigners Exempt from Work Permit

ARTICLE 9- (1) Although there is a work permit exemption for those exempted from work permits through bilateral or multilateral agreements to which Turkey is a party pursuant to subparagraph (a) of paragraph 1 of Article 55 of the Regulation on the Implementation of the Law on Work Permits for Foreigners, foreigners whose permanent residence is abroad and who will come to Turkey temporarily for less than one month for the purpose of scientific, cultural and artistic activities pursuant to subparagraph (b), foreigners who come to universities and public institutions and organizations to increase their knowledge and experience by proving their status with documents to be submitted, not exceeding two years and limited to the duration of education, pursuant to subparagraph (e), and foreign nationals who are notified by the relevant authorities that they can provide important services and contributions to Turkey in socio-cultural and technological fields and education in a period not exceeding six months pursuant to subparagraph (f) a "Work Permit Exemption Confirmation Document", the form and content of which will be determined by the Ministry, is issued to foreigners who are exempt from work permit, upon their request for foreign nationals listed below, based on the aforementioned regulation. In accordance with Article 56, they are requested to obtain a Work Permit Exemption Confirmation Document from the Ministry of Labor and Social Security. 

 

a) Those accepted or invited as guest lecturers for less than one month,

 

b) Those who are accepted or invited as visiting researchers for less than one month and later decided to give lecture.

 

(2) It is the responsibility of visiting researchers or visiting lecturers with work permit exemption, to obtain a residence permit by informing the police authorities of the place where they will stay about the purpose of their arrival, how long and where they will stay for within thirty days at the latest from the date they entered Turkey, and in any case before starting their activities, in accordance with paragraph 5 of Article 55 of the Regulation on the Implementation of the Law on Work Permits for Foreigners; those who do not prove in writing to the University that they have applied for a residence permit will not be able to start their activities at the University. It is obligatory to fulfill the obligations related to social security regarding those who will benefit from the exemption provisions. The identity information of foreigners for whom a residence permit is issued within the scope of this Article, the title of the workplaces and the Social Security Institution workplace registration numbers are notified to the Ministry of Labor and Social Security every month by the police authorities.

 

(3) The work permit of the foreign nationals specified below is obtained, except for those exempted from work permits with bilateral or multilateral agreements to which Turkey is a party, pursuant to subparagraph (a) of paragraph 1 of Article 55 of the Regulation on the Implementation of the Law on Work Permits for Foreigners:

 

a) Those who are accepted or invited as visiting lecturers for a period between one month and two months,

 

b) Those who are accepted or invited as visiting researchers and later decided to give lecture for a period of one month or more (Teaching period is between the date the lectures begin and the date they end.)

 

(4) In cases where a work permit is required:

 

a) The offer to give lecture should be made at least two months prior to the start of the lecture,

 

b) Unless a work permit is obtained, the person concerned cannot give lecture.

 

Health and workplace accident insurance

ARTICLE 10 – (1) Since the foreign national visiting lecturers and visiting researchers, who give lectures or conduct research while giving lecture at the University for less than two months, are not employed at the University, the University will not provide a health insurance; all kinds of responsibilities in this regard belong to them. Visiting lecturers and visiting researchers are required to have their own health/travel, financial liability and accident insurances covering the duration of their research and/or educational activities, and to submit a valid copy of their insurance policy before starting their research.

 

(2) The cases where the visiting lecturers and visiting researchers must be insured by the University are reserved in accordance with the Social Insurance and General Health Insurance Law dated 31/5/2006 and numbered 5510.

 

SECTION THREE

OTHER PROVISIONS

 

Visiting Academic or Administrative Personnel within the Framework of Exchange Programs

ARTICLE 11- (1) The above conditions are not required for visiting academic or administrative staff and foreign national academic staff to be employed free of charge within the scope of international agreements, bilateral agreements between institutions and exchange programs such as Erasmus +, Mevlana, the regulations and bylaws of the relevant programs are applied. In cases where there is no provision in the regulations and bylaws of the relevant programs, the decisions to be taken by the Rectorate are valid.

 

SECTION FOUR

Effectiveness and Enforcement

 

Changes in Procedures and Principles

ARTICLE 12 – (1) These procedures and principles can be changed by the decision of the Izmir University of Economics Senate.

 

Effectiveness

ARTICLE 13– (1) These procedures and principles take effect on the date they are approved by the Board of Trustees of Izmir University of Economics.

 

Enforcement

ARTICLE 14-  (1) In matters where there is no provision in these procedures and principles, the decisions of the University Administrative Board are applied.

 

ARTICLE 15 - (1) The Rector of Izmir University of Economics enforces the provisions of these procedures and principles.

 

 

 

These principles entered into force with the Senate decision dated 05.05.2021 and numbered 434-A/16 and the decision of the Board of Trustees dated 07.06.2021 and numbered 453.
