CONCILIATION AND ARBITRATION TRAINING BY IZMIR UNIVERSITY OF ECONOMICS

Judges, prosecutors, and attorneys will receive training on conciliation and arbitration at Izmir University of Economics. IUE Continues Education Center (IUECEC) will provide 25 hour Conciliation on Punishment Disputes Training and 48 hour Arbitration Training for approximately 250 judges, prosecutors, and attorneys registered to Izmir Bar Association. The participants will learn how to prevent disputes between the offender and the victim.
Assoc. Prof. Dr. Nesrin Oruç Ertürk, Director of IUECEC, pointed out that the main purpose for judges, prosecutors, and attorneys to attend the training was to resolve the disputes between the offender and the victim by an arbitrator. Ertürk said, “With the Turkish Penal Code (Türk Ceza Kanunu, TCK), Law No. 5237, and the Criminal Procedure Code Criminal Procedure Code (Ceza Muhakemesi Kanunu, CMK), Law No.5271, a new procedure called ‘mediation’ has been adopted in the Turkish criminal justice system, which enables “settlement of penal disputes outside the criminal justice system.” The purpose of the arbitration is to look out for victims, recover losses and amending it instead of mere punishments.”
‘Law and Communication Together’
Ertürk stated that those who gained 5 year seniority after they graduated from faculty of law qualify to receive arbitration training, and that entering into an arbitration agreement should be entirely voluntary for both parties, and privacy policy was essential. Ertürk said that basic communication skills, negotiation, and dispute resolution methods would be taught at the training courses and she stated the following:
“We plan to provide psychology and other theoretical and practical information and skills that are necessary for arbitration. Conciliation and arbitration training will be conducted by academicians from Faculty of Law, and Faculty of Communication. Conciliation on Punishment Disputes training will take place at Izmir University of Economics while the Arbitration training will take place at Bayraklı Courthouse.”
